COMPRA DE PRODUCTOS

a. Placing your Order

i. Once You have selected the goods which You would like, You will be asked to register your personal details with us by completing a registration form. Registration is not required; however We encourage registration in order to facilitate the checkout process during future orders on the Services.

ii. By placing an order with us, You represent and warrant that You are legally capable of signing binding agreements.

iii. When You place an order for goods via the Services, your order constitutes an offer to purchase goods from us. Where You order more than one item, your order comprises a series of offers for each item individually.

iv. After placing an order with us, you will access an order confirmation webpage and receive an order confirmation email (together the “Order Confirmations”). The Order Confirmations set out the final details of the order which you have submitted to the Services. Please take care when placing your order, as you will be unable to add to or amend your order after we send the Order Confirmations.

v. By placing an order with us, you represent and warrant that you are legally capable of signing binding agreements

b. Order Acceptance

Although we hope to be able to supply all goods ordered, we reserve the right, at our sole discretion, not to accept any offer. Should we reject your order, we will notify you as soon as reasonably possible (and, if payment has occurred, we would refund your payment).

c. Payment

i. We will take payment from your credit card, gift card, Paypal account and other future forms of payment available at the time your order is shipped. You will receive an email or post mail detailing what items have been shipped from your order (the “Invoice Email”). If your order is split into multiple shipments, we will charge you only for the items actually shipped at that time.

ii. Except where otherwise set out in these Terms of Sale, the price payable by you for the goods is the price given by the Services at the time you place your order. Applicable taxes and the delivery fee will be added at the time you place your order, but will not affect the base price of the goods.

d. Shipping and Delivery

i. After we send you your Order Confirmation e-mail, we will send you a separate Shipping Confirmation email. The Shipping Confirmation email will include a tracking number that you may use to track your order on our delivery service provider’s website and obtain an estimated delivery date.

ii. The goods will be delivered by a delivery service provider to the delivery address specified by you during the order process. Once the goods have been delivered to the address you provided, you become the owner of those goods and from that point they will be at your risk. This means you will be liable for any subsequent damage, loss or destruction.

Please allow up to 3 business days for your order to process before it ships and 2 more days for delivery. We do our best to ensure timely deliveries, but please note that shipments can occasionally be delayed due to major holidays or unforeseen circumstances. Tracking numbers will be provided for all orders.

CANCELACIÓN DE UN PEDIDO Y DEVOLUCIÓN DE PRODUCTOS

a. Puedes cancelar tu pedido en el plazo de una hora desde su realización.

b. Consulta nuestra Política de devoluciones para obtener más información sobre la devolución de los productos.

c. Nos reservamos explícitamente el derecho a rechazar cualquier pedido o cancelar cualquier compra en cualquier momento en los siguientes casos, sujeto a cualquier reembolso aplicable: (i) los productos no están disponibles o no hay existencias; (ii) los datos que nos facilitas en relación con tu compra son incorrectos o no pueden comprobarse; (iii) el pedido se marca como sospechoso o indicativo de fraude o ilegalidad por nuestros sistemas de seguridad; (iv) tenemos motivos para creer que la compra está destinada a una actividad comercial posterior; (v) se ha producido un error en el precio indicado de los productos; (vi) tenemos motivos para creer que eres menor de edad en tu jurisdicción de residencia y no cuentas con el consentimiento paterno; o (vii) no podemos entregar los productos en la dirección que nos has facilitado.

CONDICIONES GENERALES SOBRE NUESTRA RELACIÓN CON LOS USUARIOS

a. Limitación de responsabilidad. EN LA MEDIDA EN QUE LO PERMITA LA LEGISLACIÓN APLICABLE, EN NINGÚN CASO LUXOTTICA SERÁ RESPONSABLE DE NINGÚN DAÑO INDIRECTO DERIVADO O RELACIONADO DE CUALQUIER MODO CON EL USO DEL SITIO WEB O DE UN PRODUCTO ADQUIRIDO EN EL SITIO WEB. SIN PERJUICIO DE LO ANTERIOR, LA RESPONSABILIDAD TOTAL DE LUXOTTICA POR CUALQUIER MOTIVO RELACIONADO CON EL USO DEL SITIO WEB O LOS BIENES ADQUIRIDOS EN EL MISMO NO EXCEDERÁ DEL IMPORTE TOTAL QUE EL USUARIO NOS HAYA ABONADO EN RELACIÓN 1CON EL OBJETO DEL LITIGIO CONCRETO. 

b. Garantías. SEGÚN LO PERMITA LA LEY APLICABLE Y SALVO QUE SE ESTABLEZCA EXPRESAMENTE DE OTRO MODO EN LA POLÍTICA DE GARANTÍAS: (I) ESTE SITIO WEB Y TODOS LOS PRODUCTOS ADQUIRIDOS POR EL USUARIO A TRAVÉS DEL SITIO WEB SE PROPORCIONAN "TAL CUAL"; Y (II) LUXOTTICA NO OFRECE NINGUNA DECLARACIÓN NI GARANTÍA SOBRE EL SITIO WEB NI SOBRE LOS PRODUCTOS ADQUIRIDOS POR EL USUARIO A TRAVÉS DEL SITIO WEB PARA NINGÚN FIN, Y RENUNCIA EXPRESAMENTE A TODA GARANTÍA EXPRESA O GARANTÍA DE IDONEIDAD PARA UN FIN DETERMINADO. 

c. Acontecimientos que escapan a nuestro control razonable (fuerza mayor). No seremos responsables de ningún retraso o incumplimiento de estas Condiciones de venta o de las Políticas adicionales si el retraso o incumplimiento se debe a cualquier acontecimiento que esté fuera de nuestro control razonable. Tales acontecimientos incluirían (entre otros) incendios, inundaciones, terremotos, tormentas, catástrofes naturales, guerras, disturbios civiles, pandemias, actos de terrorismo, daños malintencionados, destrucción de nuestras instalaciones, equipos o mercancías, o cualquier acto realizado en virtud de una disputa comercial o escasez de mano de obra. 

d. Renuncia. El retraso en el ejercicio o la falta de ejercicio por nuestra parte de cualquier derecho o recurso en virtud de estas Condiciones de venta, no constituirá una renuncia a nuestros derechos y recursos en virtud de las mismas. 

e. Nulidad. En caso de que una o más de las condiciones establecidas en estas Condiciones de venta o en las Políticas adicionales sea declarada inválida por una autoridad competente, las restantes condiciones de las Condiciones de venta y las Políticas adicionales seguirán teniendo efecto y el Usuario seguirá estando obligado por ellas. 

f. Privacidad. La información personal identificable que nos proporciones durante el proceso de pedido se utilizará de acuerdo con nuestra Política de privacidad.

g. Cesión. Luxottica puede ceder, transferir o subcontratar cualquiera de nuestros derechos u obligaciones en virtud de estas Condiciones de venta a cualquier tercero a nuestra discreción. 

h. Ley aplicable. Según lo detallado anteriormente en la sección 17 de las Condiciones de uso.
